IWH LLC services permit subscribers to host and make available content over the Internet. These legal conditions explain how copyright infringement notices, counter notifications, and related legal requests should be sent to IWH LLC through www.iwh.net.

1. Copyright Infringement Notices

Although IWH LLC does not affirmatively screen subscriber content, IWH LLC does not tolerate infringing material on its equipment or through its services, and may remove content that appears to infringe any copyright or other intellectual property rights.

If you believe that your copyright in any material has been infringed on a site hosted on IWH LLC's equipment or through its services, please send the DMCA Notice described below to IWH LLC's Copyright Agent for Notice of Claims of Copyright Infringement.

Once IWH LLC receives a complete DMCA Notice, we will evaluate the notice and take such action as is appropriate under the Digital Millennium Copyright Act, 17 U.S.C. Section 512 et seq.

2. DMCA Notice Requirements

Federal law requires your DMCA Notice to include the following information:

  1. Identification of the copyrighted work that you claim has been infringed.
  2. Identification of the material, including URL, that you claim is infringing, with enough detail for us to locate it.
  3. Your address, telephone number, and email address.
  4. A statement under penalty of perjury that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; that the information in your notice is accurate; and that you are the owner of the copyright interest involved or are authorized to act on behalf of that owner.
  5. Your physical or electronic signature.

Please note that IWH LLC, in its sole discretion, may terminate the account of any subscriber about whom IWH LLC receives more than one complaint of copyright infringement.

4. Counter Notification

If a copyright infringement notice has been wrongly filed against you because of mistake or misidentification of the material, you may file a counter notification with IWH LLC's Designated Agent.

The counter notification must provide the following information:

  1. The subscriber's physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. The subscriber's name, address, telephone number, and email address, plus a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or, if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification or an agent of that person.

If one or more provisions of these terms is held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability will not affect any other provision contained in these terms, which will remain valid and enforceable.
